IPR Issues related to the development, rollout and exploitation of Living Labs

The European IPR Helpdesk, managed by the European Commission’s Executive Agency for Competitiveness and Innovation (EACI), with policy guidance provided by the European Commission’s Enterprise & Industry Directorate-General publishes a monthly bulletin on IPR issues in the European research and innovation landscape.

In their recent bulletin (nr 6 July-September 2012) they are featuring an article by Hans Bracquené (Braquené Legal Consulting) based on a workshop organised by ENoLL and recently ended Apollon-project on IPR issues related to the development, roll-out and exploitation of Living Labs, based on following themes:
1. How to deal with the test results achieved while using the platform to test a specific product of service?
2. What if the use of the FOT (field operational test i.e living lab) leads to product improvements or even to the development of a new product?
3. How to protect the Background related to the management of a Test Panel?
4. What specific contracts with the test persons are required?
